End-User License Agreement (EULA)

1. Agreement

This End-User License Agreement ("EULA") is a legal agreement between you ("User") and Wartraf sp. z o.o. ("Wartraf", "Licensor"), registered at Straganarska 20-21/35, Gdansk, 80-837, Poland (NIP: 5833620802), for the use of the Wartraf TikTok application ("the App"). By installing, accessing, or using the App, you agree to be bound by the terms of this EULA.

2. License Grant

Wartraf grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for internal business purposes within the Wartraf organization. This license does not permit you to sublicense, distribute, or make the App available to any third party.

3. Scope of Use

The App is designed for internal team use only and provides functionality for budget viewing and company management within the Wartraf enterprise. You may use the App only in connection with your authorized role within the organization and in accordance with applicable internal policies.

4. Data Handling

All data entered into, generated by, or accessible through the App remains the property of Wartraf sp. z o.o. No data collected or processed through the App is shared with any third parties. The App and all associated intellectual property rights, including but not limited to code, design, architecture, documentation, and trademarks, are and shall remain the exclusive property of Wartraf sp. z o.o. This EULA does not convey any ownership rights to you.

7. Updates and Modifications

Wartraf may, at its sole discretion, update, modify, or discontinue the App or any of its features at any time without prior notice. Such updates may be applied automatically. Continued use of the App after any update constitutes acceptance of the modified version.

8. Termination

This EULA is effective until terminated. Wartraf may terminate this license at any time without notice if you fail to comply with any of its terms. Upon termination, you must immediately cease all use of the App and destroy any copies in your possession. Sections relating to intellectual property, confidentiality, limitation of liability, and governing law shall survive termination.

9. Disclaimer of Warranties

The App is provided "as is" without warranty of any kind, express or implied. Wartraf disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Wartraf does not warrant that the App will meet your requirements, operate without interruption, or be free from errors or defects.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Wartraf be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with the use or inability to use the App, even if Wartraf has been advised of the possibility of such damages.

11. Governing Law and Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of the Republic of Poland. Any dispute arising from or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Gdansk, Poland.

12. Entire Agreement

This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Wartraf regarding the App and supersedes all prior agreements, understandings, and communications.
